SELECTION OF PROPERTY

The purchase of property through the ANTIQON website is completed through several successive stages:

  • selection of the property on the website;
  • clicking the “Buy” button;
  • placing an order and providing the required information;
  • order confirmation by the Seller;
  • payment for the property;
  • collection or delivery of the property.

The display of property on the website does not constitute a public offer.

By clicking the “Buy” button, the Buyer submits an offer to enter into a contract of sale.

A contract of sale shall be deemed concluded only upon confirmation of the order by the Seller.

Prior to placing an order, Buyers are encouraged to carefully review:

  • the property description;
  • photographs;
  • dimensions and measurements;
  • materials;
  • the Condition Report;
  • information regarding restorations and condition-related features;
  • payment, shipping, and export conditions.

Prior to placing an order, the Buyer may request additional information from ANTIQON regarding the property, including additional photographs, clarification of dimensions, condition, completeness, storage conditions, restorations, provenance, and other characteristics of the property, to the extent such information is available to ANTIQON.

A property may become unavailable prior to order confirmation.

ANTIQON reserves the right to refuse order confirmation in the event of:

  • a technical error;
  • an error in the price, description, or characteristics of the property;
  • unavailability of the property;
  • restrictions related to AML/KYC requirements, sanctions regulations, or internal security procedures.

PRICE AND AVAILABILITY

All prices displayed on the ANTIQON website are stated in euros (EUR), unless expressly indicated otherwise in the property description.

Unless otherwise specified in the property listing or sale conditions, shipping costs are included in the purchase price.

In certain cases, additional charges may apply for:

  • special packing;
  • insurance;
  • export documentation and export permits;
  • customs duties, taxes, and import charges;
  • other additional expenses related to shipping or fulfilment of the order.

Where applicable, such costs will be communicated to the Buyer prior to order confirmation or during the checkout process.

The presentation of property on the website is for informational purposes only and does not constitute a public offer.

The availability of property, the possibility of sale, the final purchase price, and the terms of fulfilment of the order are subject to separate confirmation by the Seller.

A property may be unavailable at the time of order confirmation, including in the following circumstances:

  • simultaneous purchase requests submitted by another Buyer;
  • sale of the property through the gallery, auction, or other sales channels;
  • technical error;
  • error in the price, description, or characteristics of the property;
  • inability to complete the transaction for reasons beyond ANTIQON’s control.

ANTIQON reserves the right to cancel an order prior to confirmation in the event of a material error, unavailability of the property, non-compliance with AML/KYC requirements, sanctions-related restrictions, or any other circumstances preventing completion of the transaction.

Submission of an order does not automatically reserve the property and does not constitute the conclusion of a contract of sale.

A contract of sale shall be deemed concluded only upon confirmation of the order by the Seller.

PAYMENT

Payment may be made only after confirmation of the order by the Seller.

The payment deadline is specified in the invoice, order confirmation, or sale conditions applicable to the relevant property.

Available payment methods may include:

  • bank transfer;
  • credit or debit card;
  • PayPal (where available);
  • other payment methods specified on the website or agreed with ANTIQON.

Payment must be made by the Buyer or by a person legally authorised to act on behalf of the Buyer.

In certain cases, ANTIQON reserves the right to:

  • request additional documents or information;
  • conduct AML/KYC verification;
  • request confirmation of the source of funds;
  • temporarily suspend fulfilment of the order until verification has been completed.

All bank charges, payment processing fees, currency conversion costs, and other expenses associated with the payment shall be borne by the Buyer unless otherwise expressly agreed by the parties.

An order shall be deemed paid only upon actual receipt of the funds in the Seller’s account.

If payment is not received within the specified period, ANTIQON reserves the right to:

  • cancel the order;
  • remove any reservation of the property;
  • offer the property to another Buyer;
  • refuse future orders or restrict access to certain platform services.

SHIPPING AND COLLECTION

The Buyer may:

  • collect the property in person;
  • use shipping services arranged by ANTIQON;
  • use a transport or logistics company;
  • authorise a third party to collect or receive delivery of the property.

Unless otherwise specified in the property listing or sale conditions, shipping is included in the purchase price.

In certain cases, additional charges may apply for:

  • special packing;
  • insurance;
  • express delivery;
  • export documentation and export permits;
  • customs duties, taxes, and import charges;
  • other expenses related to the fulfilment of delivery.

Delivery times are estimates only and may depend on:

  • the destination country;
  • the performance of carriers;
  • customs procedures;
  • export restrictions;
  • the nature of the property;
  • other circumstances beyond ANTIQON’s control.

Certain categories of property may require export documentation or cultural property export permits in accordance with applicable legislation.

If the Buyer authorises a third party to collect the property, the Buyer must provide ANTIQON in advance with written authorisation or a power of attorney containing the details of the authorised person.

If delivery is arranged in the name of a third party or to an address different from that of the Buyer, the Buyer must complete and submit a Delivery Request Form in advance.

Release of the property shall take place only after full payment of all applicable amounts.

The risk of accidental loss or damage to the property passes to the Buyer:

  • upon physical receipt of the property by the Buyer; or
  • upon delivery of the property to a carrier where shipment is arranged on behalf of the Buyer.

If the property is not collected within the applicable period, ANTIQON reserves the right to charge storage fees or transfer the property to an external storage facility.

SELLER AND CONTRACTING PARTY

The seller in the transaction is SIA ANTIQON, a company registered in the Republic of Latvia.

The Seller is the party to the contract of sale, receives payment, confirms the order, releases the property, and issues the relevant accompanying documentation unless otherwise expressly stated in the sale conditions.

Contact addresses, representative offices, partners, or affiliated ANTIQON companies located in other countries may perform exclusively:

  • informational functions;
  • marketing functions;
  • organisational functions;
  • service-related functions;
  • representative functions.

Such persons or entities shall not be considered a party to the contract of sale unless expressly stated otherwise in the transaction documentation.

All payments, rights, and obligations of the parties are governed by the terms of the transaction with the Seller identified in the order documents, invoice, or purchase confirmation.

Information regarding the Seller, company details, and applicable legal conditions is provided:

  • in the order documentation;
  • on the invoice;
  • in the legal information section of the website;
  • in the applicable Buy Now Terms.

CONDITION AND DESCRIPTION OF PROPERTY

The property offered on the ANTIQON website consists of works of art, antiques, collectibles, and decorative arts objects.

Due to the nature, age, and history of use of such property, the following may be present:

  • natural signs of age;
  • wear and tear;
  • restorations;
  • replacement of individual elements;
  • minor losses;
  • storage and usage-related characteristics;
  • other condition-related features typical of antique and collectible property.

Descriptions of property, photographs, attribution, dimensions, provenance information, period of creation, materials, techniques, and condition are prepared on the basis of information available to ANTIQON at the time of publication.

Expert opinions, reports, and attributions are provided for professional and informational purposes.

Photographs form part of the description of the property. However, colour tones, texture, scale, and certain details may vary depending on screen settings, lighting conditions, or photographic techniques.

Prior to placing an order, Buyers are encouraged to carefully review:

  • dimensions and measurements;
  • the Condition Report;
  • information regarding restorations and condition-related features.

Prior to purchase, the Buyer may request additional information from ANTIQON, including additional photographs, clarification of dimensions, condition, completeness, restorations, provenance, and other characteristics of the property, to the extent such information is available to ANTIQON.

All property is sold in the condition described and in its actual condition at the time of sale, unless expressly stated otherwise in the property description.

ANTIQON guarantees that the property corresponds to its description, attribution, identity, and accompanying documentation to the extent specified in the property listing and related documentation.

For certain property, ANTIQON may provide certificates, expert reports, curatorial statements, provenance documentation, and other supporting materials confirming the description, attribution, provenance, or characteristics of the property.

Such documents form part of the accompanying documentation of the property and should be retained together with the property as part of its collection and archival history.

Certificates and accompanying documentation constitute an important element of the identification and provenance of the property.

Failure of the property to meet the Buyer’s subjective expectations, including expectations regarding natural ageing, degree of wear, or anticipated investment or market value, shall not constitute grounds for claims, return of the property, or withdrawal from the transaction, unless otherwise required by applicable law.

RETURNS AND RIGHT OF WITHDRAWAL

The right of withdrawal and conditions for returning property are governed by applicable legislation, the Buy Now Terms, and the conditions of the relevant transaction.

Given the nature of the property offered for sale, including works of art, antiques, and collectibles, Buyers are encouraged to carefully review the property description, photographs, Condition Report, and accompanying documentation before completing a purchase.

Where provided by applicable law, the Buyer may exercise the right of withdrawal within the statutory period.

In order to qualify for return, the property must:

  • remain in the same condition in which it was delivered to the Buyer;
  • retain its completeness and accompanying documentation;
  • show no new damage, signs of use, restoration, or alteration of condition.

A return may be refused in the event of:

  • alteration of the condition of the property after delivery to the Buyer;
  • damage to the property;
  • loss of certificates, accompanying documentation, or components forming part of the property;
  • failure to comply with return requirements;
  • any exception provided by applicable law or the conditions of sale.

Unless otherwise required by applicable law or agreed separately by the parties, all costs associated with returning the property, including packing, transportation, insurance, customs duties, and related expenses, shall be borne by the Buyer.

Any refund shall be processed only after the Seller has received and inspected the property.
